Withdrawal Right

The Customer has the right to withdraw from the purchase contract for any reason whatsoever, without the need to provide explanations and without any penalty, subject to the cases of exclusion provided for in Section IV below. To exercise this right, the Customer must send Alemanni Sub di Alemanni Itio e C. Snc a notice within 14 days from the date of receipt of the Products by sending an email to customer service info@alemanni-sub.it if it intends to exercise the withdrawal before having received the Products, the withdrawal notice may be sent at any time prior to their receipt.

The Customer Service of Alemanni Sub di Alemanni Itio e C. Snc will provide, once received the communication, to open a file for the management of the return and to communicate to the Customer instructions on how to return the Products, which will take place via courier indicated by Alemanni Sub di Alemanni Itio e C. Snc itself.

The right of cancellation is governed by the following conditions:

a. The right applies to the Product purchased in its entirety; therefore, if the Product is composed of several components or parts, it is not possible to exercise withdrawal only on part of the Product purchased.

b. If the right of withdrawal is exercised, Alemanni Sub di Alemanni Itio e C. Snc will reimburse the customer the entire amount of the returned goods, including shipping costs where applicable, within 14 days from the date the notice of withdrawal was received, without prejudice to the right of Alemanni Sub di Alemanni Itio e C. Snc to suspend payment of the refund until actual receipt of the goods. The refund will be made using the same method of payment used by the Customer, unless the Customer has expressly requested a different method. In case of bank transfer, it will be the Customer’s responsibility to provide the bank details on which to obtain the refund (account holder, name and address of the Bank and IBAN).

c. Also in order to be able to guarantee free return under Article 8 below, the Products must be returned in the same box in which they were received.

d. In addition to the cases mentioned in the Foreword (non-consumer customer and/or requesting invoice), the right of withdrawal is excluded in the following cases, according to Art. 59 d.lgs 21/2014:

• Ordering custom-made or clearly customized Products;
• order of Products that are likely to deteriorate or expire quickly;
• order of sealed Products that are not suitable for return for hygienic or health protection-related reasons or that have been opened after delivery.

With reference to the cases of exclusion of withdrawal listed above, the Customer, in particular, is informed and accepts that the Products that are “likely to deteriorate or expire rapidly” include both all food products (including wines, spirits and beverages) and cosmetics, since the characteristics and qualities of these types of Products are also subject to alteration as a result of inappropriate storage. Therefore, for reasons of hygiene and protection of Customers, the right of withdrawal is applicable only to Products purchased on the Online Shop which can be returned to Alemanni Sub di Alemanni Itio e C. Snc and put back on the market without danger to the health of consumers (such as books, gadgets, kitchen utensils, etc.).

In cases where the right of withdrawal is excluded, Alemanni Sub di Alemanni Itio e C. Snc will return the purchased Products to the Customer, charging him/her for the shipping costs.
